One side-effect of the Sixth Circuit’s updated opinion in Bridgeport Music v. Dimension Films William Patry’s comments on the new opinion are here), regarding sampling as copyright infringement: We now know that in the Sixth Circuit, two notes can constitute an original copyrighted sound recording; one note cannot.
