While analyzing the substantial similarity and scenes a faire issues would be fun, I’m afraid the reality is much less interesting: no clearance needed, since they’re both Warner Brothers pictures.

Yes, it’s something of a trick question! But I’m teaching Copyright Law this Spring, and the hypo is a nice up-to-date variation on the Steinberg case. What if Soderbergh were a true independent?
