Memo to future mass-murderers: Before sending out your confession/manifesto, be sure to choose the appropriate Creative Commons license for it (not that I want to make light of the tragedy, but I suspect in the future someone might actually do that sort of licensing).

"They may also have an implied license argument to broadcast the tape. Even so, there’s presumably a limit to how far these arguments take NBC, and I’m not sure that they can shield YouTube’s users who’ve posted the tape."

Fred, why is there presumably a limit here? Cho wanted his tape to be broadcast to the world, right? That was why he mailed his materials to NBC before killing 30-odd people and then himself.

If Cho held a copyright at his death, then his estate holds the copyright now. His victims (or their estates) have excellent tort claims against the estate. A victim's family member could secure a judgment against the Cho estate and then assert ownership of the copyright, either to profit or to suppress further publication.
