Jacobsen appealed Judge White's decision a second time to CAFC. The SFLC filed an amicus brief supporting Jacobesen wherein, ACT filed an amicus brief supporting Katzer's postion. See District Court document 338 or 339 written by one of the District Court judges responsibile for the management of the discovery process. This document should add clarity to this case. Update………
