Arthur Hellman on “lottery” aspect of death penalty appeals

“It looks very much like a lottery,” Professor Arthur Hellman commented in response to newly collected data on habeas corpus death penalty decisions by the Sixth Circuit Court of Appeals. The study by the Cincinnati Enquirer showed extreme differences among the judges of the court in their votes on convicted murderers’ challenges to death sentences.
