Parental Vicarious Liability

Eric Goldman concludes: Dad is vicariously liable for daughter’s copyright infringement via KaZaA. Is that right? Do state parental responsibility laws (which would make Dad liable) automatically kick in here, or do vicarious liability standards under federal copyright law apply? Under the latter, is Dad so clearly responsible?
