Copyright and Social Practices

I’ve been giving talks centered on what I call a social patterns or social practices approach to copyright law, using fair use as a point of entry. Here’s the long version of the argument. I always get asked: what is a social pattern? what is a social practice? How can we define the law according to something that we can’t see? I’ve argued that we can see them.
