The plaintiff’s prima facie claims are pretty straightforward; if it cares at all, Hallmark has to hope that it can pull off some flavor of a First Amendment defense. Is the card a non-confusing parodic use of Paris’ image and catch phrase? The problem, it seems to me, is that Paris may be parody-proof.
